Alexandru St\u0103nciulescu B\u00e2rda<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\" align=\"center\">ELEMENTE DE MEDICIN\u0102 LEGAL\u0102<\/p>\n<p style=\"text-align: justify;\" align=\"center\">\n<p style=\"text-align: justify;\"><strong>6.1. Reglement\u0103ri privind asisten\u0163a sanitar\u0103:<\/strong><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>6.1.1. <em>Medicul\u00a0 \u00een via\u0163a comunit\u0103\u0163ii. <\/em><\/strong>\u00cenc\u0103 de la sf\u00e2r\u015fitul veacului al XVIII-lea, medicul \u00ee\u015fi face prezen\u0163a \u00een documentele analizate, at\u00e2t la nivel de sta, c\u00e2t \u015fi la nivel de ora\u015f. \u00cen 30 noiembrie 1783, episcopul Vichentie al V\u00e2r\u015fe\u0163ului \u00eendemna pe preo\u0163ii \u015fi pe enoria\u015fii s\u0103i s\u0103 urmeze \u015fcoli mai \u00eenalte, \u015fcoala fiind elementul de baz\u0103, care ar fi putut s\u0103 le schimbe via\u0163a \u00een bine. Le recomanda \u00een acest sens Universit\u0103\u0163ile din Pesta \u015fi Viena, unde se putea\u00a0 studia<strong> <\/strong>medicina, dreptul \u015fi filozofia. Absolven\u0163ii acestei universit\u0103\u0163i\u00a0 devin apoi prezen\u0163i \u00een mase, contribuind\u00a0 asigur\u00e2nd, pe c\u00e2t se putea, asisten\u0163a sanitar\u0103. E posibil ca medici s\u0103 fi existat la \u00eenceput doar \u00een ora\u015fele mari, dup\u0103 care, \u00eenmul\u0163indu-se cadrele, s-au r\u0103sp\u00e2ndit \u015fi-n or\u0103\u015felele de\u00a0 provincie. Din documente afl\u0103m c\u0103 \u00een fiecare sat medicul avea datoria s\u0103 vin\u0103 o dat\u0103 sau de dou\u0103 ori pe an, \u00een mod obi\u015fnuit, s\u0103 fac\u0103 consulta\u0163ii celor bolnavi, s\u0103 le prescrie medicamente sau alte remedii\u00a0 pentru bolile de care sufereau.\u00a0 \u00cen caz\u00a0 de epidemii, precum variola, medicii\u00a0 trebuiau s\u0103 mearg\u0103 \u00een fiecare sat din zonele afectate \u015fi s\u0103 ,,<em>oculeze\u201d<\/em>(vaccineze) copiii cu ,,<em>bube de vac\u0103\u201d, <\/em>pentru a-i face imuni la epidemie. Medicii erau ajuta\u0163i \u00een sate \u015fi mai ales \u00een zonele gr\u0103nicere\u015fti de c\u0103tre moa\u015fe. Acestea asigurau asisten\u0163a medical\u0103 femeilor care n\u0103\u015fteau. Ele nu aveau \u015fcoal\u0103 propriu-zis\u0103, ci erau doar \u00eendrumate, instruite, probabil de medicii, care le \u015fi controlau, apoi, activitatea. Nu cunoa\u015ftem cum erau retribuite, dar se pare c\u0103 satele contribuiau la sus\u0163inerea lor. Medicul avea datoria s\u0103 se prezinte la casa fiec\u0103rui mort, s\u0103-l vad\u0103, s\u0103 constate\u00a0 decesul, s\u0103 stabileasc\u0103 apoi cauza mor\u0163ii \u015fi s\u0103 elibereze certificatul de deces, f\u0103r\u0103 de care preotul nu avea voie s\u0103 oficieze \u00eenmorm\u00e2ntarea \u015fi nici s\u0103 treac\u0103 pe cel decedat \u00een registrul de stare civil\u0103 al deceda\u0163ilor. \u00cen realitate, se pare c\u0103 nu se ducea medicul la domiciliul mortului, ci doar elibera certificat de constatare a mor\u0163ii. Este interesant de constatat c\u0103 \u00een octombrie 1819, protopopul Nicolae Stoica de Ha\u0163eg comunica hot\u0103r\u00e2rea \u00eemp\u0103r\u0103teasc\u0103, prin care stabilea c\u0103 pe teritoriul Imperiului\u00a0 Habsburgic nu au voie s\u0103 profeseze dec\u00e2t medicii care erau absolven\u0163i ai facult\u0103\u0163ilor de medicin\u0103 de la Universit\u0103\u0163ile\u00a0 din\u00a0 Viena \u015fi Pesta. Era interzis\u0103 activitatea celor care ob\u0163inuser\u0103 ,,<em>diplom\u0103 de doctorie de la universit\u0103\u0163ile al(tor) \u0163\u0103ri streine\u201d<\/em><a title=\"\" href=\"#_ftn1\"><sup><sup>[1]<\/sup><\/sup><\/a><em>.<\/em><\/p>\n<p style=\"text-align: justify;\"><strong>6.1.2. <em>M\u0103suri profilactice. <\/em><\/strong>Preo\u0163ii erau folosi\u0163i de c\u0103tre administra\u0163ia statului la lupta de prevenire a r\u0103sp\u00e2ndirii unor boli molipsitoare, precum ciuma, holera sau altele de acest gen necunoscute. Pentru aceasta li se transmiteau ordine ale conducerii de stat privitoare diferite slujbe, \u00een cadrul c\u0103rora trebuiau introduse anumite reguli menite s\u0103 schimbe unele practici intrate \u00een obi\u015fnuin\u0163a poporului. Dintre\u00a0 acestea amintim urm\u0103toarele:<\/p>\n<p style=\"text-align: justify;\"><em>\u00a0<\/em><\/p>\n<p style=\"text-align: justify;\" align=\"center\"><em>A. La \u00eenmorm\u00e2nt\u0103ri:<\/em><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>Interzicere de a \u0163ine mortul descoperit de la deces p\u00e2n\u0103 la \u00eenmorm\u00e2ntare. <\/strong>Se interzicea \u00een mod categoric de a se transporta mortul de acas\u0103 p\u00e2n\u0103 la biseric\u0103, respectiv la cimitir, cu sicriul descoperit. Dimpotriv\u0103, cei care fuseser\u0103 bolnavi, trebuiau acoperi\u0163i \u00een sicriu cu var nestins, dup\u0103 care li se fixa capacul la sicriu \u015fi nu mai era desf\u0103cut<a title=\"\" href=\"#_ftn2\"><sup><sup>[2]<\/sup><\/sup><\/a>. Aceast\u0103 dispozi\u0163ie nu se respecta \u00eens\u0103 \u00eentru totul \u00eentotdeauna(II, f. 64 v. -65 r.). Faptul c\u0103 epidemiile secerau nenum\u0103rate vie\u0163i la vremea aceea,\u00a0 este\u00a0 un motiv \u00een plus ca regulamentele, deciziile \u015fi ordinele s\u0103 fie numeroase \u00een acest sens. Medicina la vremea respectiv\u0103 se ar\u0103ta neputincioas\u0103 ca s\u0103 fac\u0103 fa\u0163\u0103 unor epidemii precum ciuma sau holera. Totu\u015fi, se insista pe m\u0103suri\u00a0 preventive. Uneori dispozi\u0163iile veneau direct de la \u00eemp\u0103ratul de la Viena sau de la regele maghiar \u015fi erau transmise \u00een teritoriu prin\u00a0 organele biserice\u015fti, civile \u015fi militare.\u00a0 \u00cen\u00a0 27 martie 1778, spre exemplu, venise ordin de la\u00a0\u00a0 rege, de la ,<em>, ce sfin\u0163it\u0103 chesaro-cr\u0103iasc\u0103 \u015fi apostoliceasc\u0103 m\u0103rire\u201d ,<\/em> ordin care era actualizat \u00een prim\u0103vara lui 1784, care interzicea ca mor\u0163ii s\u0103 mai fie \u0163inu\u0163i de la deces\u00a0 p\u00e2n\u0103 la \u00eenmorm\u00e2ntare cu fa\u0163a descoperit\u0103. Astfel, ei trebuiau pu\u015fi imediat \u00een sicrie \u015fi acestora trebuia s\u0103 li se a\u015feze capacul \u015fi s\u0103 se fixeze \u00een cuie, pentru a nu se mai r\u0103sp\u00e2ndi microbii. \u00cen 1835, ca urmare a pl\u00e2ngerii comenduirii militare a Banatului c\u0103tre episcopul de V\u00e2r\u015fe\u0163, acesta d\u0103dea ordin preo\u0163ilor din eparhie ca s\u0103 interzic\u0103 oamenilor a mai duce mor\u0163ii \u00een co\u015fciuge \u00eenchise sau deschise la biseric\u0103 \u015fi de acolo la cimitir, prilej cu care se puteau transmite multe boli. Se reglementa ca slujba \u00eenmorm\u00e2nt\u0103rii s\u0103 se fac\u0103 acas\u0103 la mort, dup\u0103 care se acoperea co\u015fciugul \u015fi-l duceau direct la cimitir. Se putea face slujba \u015fi la cimitir<a title=\"\" href=\"#_ftn3\"><sup><sup>[3]<\/sup><\/sup><\/a>. Documentele analizate ne ajut\u0103 s\u0103 \u00een\u0163elegem c\u0103 restric\u0163iile de genul acesta erau valabile doar pentru popor, \u00een timp ce autorit\u0103\u0163ile le \u00eenc\u0103lcau f\u0103r\u0103 jen\u0103. A\u015fa, bun\u0103oar\u0103, \u00een 1819, \u00een plin\u0103 epidemie de cium\u0103, a murit episcopul Petru Vidac(9 decembrie 1819). Z\u0103cuse nou\u0103 zile \u015fi nimeni nu-i\u00a0 putuse diagnostica sau vindeca boala. Trupul mort al episcopului a fost \u0163inut ,,\u015fapte zile \u00eentregi la priveli\u015ftea norodului z\u0103cu, c\u00e2t s\u0103 f\u0103cu\u00a0 \u00een firea sa ce-au fost \u015fi de at\u00e2ta mult norod, f\u0103r\u0103 deschilinirea legii, ziua &#8211; noaptea ne\u00eentrerupt s-au cercetat \u015fi cu lacr\u0103mi l-au s\u0103rutat, iar a \u015faptea zi, ce fu a 15 &#8211; a a (lunii) ace\u015ftia, cu petrecanie a unui f\u0103r\u0103 de num\u0103r norod dup\u0103\u00a0 cum s\u0103 cuvine arhiere\u015ft(e)i persoane, \u00een ceasta de aicea catedralnic\u0103 biseric\u0103, pre l\u00e2ng\u0103 binecuv\u00e2ntatele oas\u0103 a r\u0103posatului domn ep(is)cop de \u015eacabent (Iosif\u00a0 \u015eacabent-n.n.) \u00een p\u0103m\u00e2nt s-au a\u015fezat\u201d<a title=\"\" href=\"#_ftn4\"><sup><sup>[4]<\/sup><\/sup><\/a><em>. <\/em>Dac\u0103 vom observa cu aten\u0163ie, multe dispozi\u0163ii de ordin bisericesc \u015fi penal, ce fuseser\u0103 date preo\u0163ilor \u015fi poporului a le pune \u00een practic\u0103 sunt \u00eenc\u0103lcare la moartea acestui episcop. Nici popula\u0163ia nu a respectat \u00eentru totul ordinele st\u0103p\u00e2nirii de acest . Dovad\u0103 este faptul c\u0103 \u00een 1878, episcopul Ioan Popasu se pl\u00e2ngea \u00eentr-o circular\u0103 c\u0103 a g\u0103sit localit\u00ee\u0163i \u00een care toate legile \u015fi regulamentele privitoare la \u00eenmorm\u00e2nt\u0103ri erau c\u0103lcate f\u0103r\u0103 remulc\u0103ri<a title=\"\" href=\"#_ftn5\"><sup><sup>[5]<\/sup><\/sup><\/a>.<\/p>\n<p style=\"text-align: justify;\"><strong>Obliga\u0163ia ca decesul s\u0103 fie constatat de medic \u015fi acesta s\u0103 elibereze certificat dup\u0103 48 de ore de la deces.<\/strong> <em>Obliga\u0163ia de a chema ,,dohtorul\u201d s\u0103 constate decesul \u015fi cauza mor\u0163ii \u015fi s\u0103 elibereze ,,carte -\u0163ertificat\u201d\u00a0 \u00eenainte de a face \u00eenmorm\u00e2ntarea <\/em><a title=\"\" href=\"#_ftn6\"><sup><sup>[6]<\/sup><\/sup><\/a><em>. \u00cen cazul \u00een care nu exista medic \u00een localitate sau \u00een zon\u0103, preotul trebuia s\u0103 cheme ,,dreg\u0103toriul st\u0103p\u00e2nirii p\u0103m\u00e2nte\u015fti, sau spre aceia r\u00e2nduitului comisariu, sau mai pre urm\u0103 natoriul(notarul-n.n.) locului \u00ee(m)preun\u0103 cu cei b\u0103tr\u00e2ni ai locului\u201d, care s\u0103 constate c\u0103 mortul nu prezint\u0103 semne c\u0103 decesul s-ar fi datorat ciumii<\/em><a title=\"\" href=\"#_ftn7\"><sup><sup>[7]<\/sup><\/sup><\/a><em>. \u00cen 1833 se admitea ca aceast\u0103 constatare a mor\u0163ii, \u00een caz de for\u0163\u0103 major\u0103, s-o poat\u0103 face \u015fi comandantul companiei\u00a0 din zon\u0103<\/em><a title=\"\" href=\"#_ftn8\"><sup><sup>[8]<\/sup><\/sup><\/a><em>. <\/em>\u00cenmorm\u00e2ntarea nu trebuia s\u0103 se fac\u0103 dec\u00e2t dup\u0103 trecerea a 48 de ore de la deces, pentru a se evita situa\u0163ia mor\u0163ilor aparente<a title=\"\" href=\"#_ftn9\"><sup><sup>[9]<\/sup><\/sup><\/a><strong> .\u00a0 <\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Obliga\u0163ia e a dezinfecta trupurile celor mor\u0163i de boli contagioase. <\/strong>Dac\u0103 cineva murea de boal\u0103 contagioas\u0103, precum lepra sau holera, ori dac\u0103 <em>,,trupurile s-au umflat\u0103 dup\u0103 ie\u015firea sufletului , sau va ar\u0103ta fa\u0163a lui groaznic\u0103 \u015fi ur\u00e2t\u0103 \u015fi dintr-\u00eensul ias\u0103 z\u0103duv\u0103 pucioas\u0103\u201d,<\/em> astfel de trupuri trebuie tratate \u00een mod special,\u00a0 cu mult\u0103 grij\u0103, pentru a nu se mai r\u0103sp\u00e2ndi boala. \u00cen acest sens, trupurile respective ,<em>,\u00eendat\u0103 cu var nestins s\u0103 se presere \u015fi \u00eenc\u0103 \u00een cas\u0103 s\u0103 se acopere sicrinul\u00a0 \u015fi cu cuie s\u0103 se \u0163intuiasc\u0103 sicrinul \u015fi la locul de \u00eengropare s\u0103 se a\u015faz\u0103. A\u015fijderea \u015fi la bisearic\u0103 duc\u00e2ndu-l s\u0103 nu-l descopere la fa\u0163\u0103<\/em>\u201d. Ordinul era repetat de c\u00e2te ori ap\u0103rea c\u00e2te o epidemie de cium\u0103, holer\u0103, variol\u0103 etc.<a title=\"\" href=\"#_ftn10\"><sup><sup>[10]<\/sup><\/sup><\/a> Pentru cei care nu ar fi respectat aceast\u0103 dispozi\u0163ie se men\u0163iona c\u0103 vor primi pedepse drastice ,,<em>de la a lor cesaro-cr\u0103iasc\u0103 m\u0103riri or\u00e2nduieli, acela unde s\u0103 va \u00eent\u00e2mpla supt pedeaps\u0103 mare va fi de la domni varmeghi\u015fti\u201d<\/em><a title=\"\" href=\"#_ftn11\"><sup><sup>[11]<\/sup><\/sup><\/a>. Varmegi\u015ftii erau poli\u0163i\u015ftii statului din teritoriu. Ei aveau ca for suprem de conducere ,,\u00eenaltul con\u0163ilium\u201d. Le este trimis\u0103 preo\u0163ilor \u015fi ordinul varmeghiei \u00een acest sens<a title=\"\" href=\"#_ftn12\"><sup><sup>[12]<\/sup><\/sup><\/a>.<\/p>\n<p style=\"text-align: justify;\"><strong>Interzicerea de a transporta mor\u0163ii dintr-o localitate \u00een alta. <\/strong>Era interzis\u0103 categoric de c\u0103tre lege \u015fi de c\u0103tre comenduirea militar\u0103 a Banatului transportarea mor\u0163ilor dintr-o localitate \u00een alta, pentru a nu se r\u0103sp\u00e2ndi bolile molipsitoare<a title=\"\" href=\"#_ftn13\"><sup><sup>[13]<\/sup><\/sup><\/a>. Chiar ofi\u0163erii \u015fi militarii, care ar fi decedat \u00een spitalele militare nu mai erau transporta\u0163i acas\u0103, la familiile lor \u015fi erau \u00eenmorm\u00e2nta\u0163i \u00een localitatea unde era spitalul respectiv, iar\u00a0 slujba \u00eenmorm\u00e2nt\u0103rii era obligat preotul locului \u00een care era spitalul s-o oficieze<a title=\"\" href=\"#_ftn14\"><sup><sup>[14]<\/sup><\/sup><\/a>.<\/p>\n<p style=\"text-align: justify;\"><strong>Anun\u0163area organelor de stat cu privire la decesele datorate unor boli contagioase. <\/strong>Preo\u0163ii erau\u00a0 obliga\u0163i c\u0103, \u00een caz c\u0103 cineva murea de boal\u0103 molipsitoare, s\u0103 anun\u0163e solg\u0103bir\u0103ul \u00een termen de paisprezece zile de la decesul respectiv, preciz\u00e2nd \u00een raport denumirea bolii\u00a0 \u015fi c\u00e2te zile a fost \u0163inut mortul \u00een cas\u0103<a title=\"\" href=\"#_ftn15\"><sup><sup>[15]<\/sup><\/sup><\/a>. Aceast\u0103 obliga\u0163ie a fost\u00a0 extins\u0103 apoi, preo\u0163ii fiind obliga\u0163i ca s\u0103 dea asemenea rapoarte din dou\u0103 \u00een dou\u0103 s\u0103pt\u0103m\u00e2ni cu privire toate cazurile de deces din parohie \u015fi cauza mor\u0163ii fiec\u0103ruia<a title=\"\" href=\"#_ftn16\"><sup><sup>[16]<\/sup><\/sup><\/a>. Preo\u0163ii\u00a0 raportau at\u00e2t solg\u0103bir\u0103ului locului, c\u00e2t \u015fi protopopului, iar protopopul era obligat s\u0103 raporteze lunar episcopului la V\u00e2r\u015fe\u0163<a title=\"\" href=\"#_ftn17\"><sup><sup>[17]<\/sup><\/sup><\/a>.<\/p>\n<p style=\"text-align: justify;\"><strong>Obliga\u0163ia de a evita adun\u0103rile de rude, cunoscu\u0163i \u015fi prieteni la casa mortului. <\/strong>Aceast\u0103 m\u0103sur\u0103 urm\u0103rea protejarea popula\u0163iei de a c\u0103dea victim\u0103 microbilor bolilor molipsitoare. Se recomanda ca la priveghiu s\u0103 participe doar rudele foarte apropiate \u015fi \u00een num\u0103r c\u00e2t mai mic. Arhimandritul Sinesie Radivoevici, loc\u0163iitorul episcopului de V\u00e2r\u015fe\u0163 scria \u00eentr-o circular\u0103 din 1827:<strong> ,,<\/strong><em>Cunoscut iaste cum c\u0103 trupurile cele moarte omene\u015fti \u00een grani\u0163a milit\u0103reasc\u0103 de multe ori de fa\u0163\u0103 spre vedere s\u0103 scot, din carea nebun\u0103 lucrare multe v\u0103t\u0103m\u0103toare bete\u015fuguri au tras r\u0103d\u0103cin\u0103. Iar fiindc\u0103 scoaterea aceasta a mor\u0163ilor din cauza str\u00e2mtori(i) l\u0103ca\u015furilor, mai cu seam\u0103 \u00een mici c\u0103sulii, prin adunarea nemoteniilor \u015fi altor iubitori de \u015ftire mai toat\u0103 zioa pl\u00e2ng\u00e2nd, de unde v\u0103t\u0103m\u0103toare adun\u0103ri s\u0103 nasc\u0103.<\/em><a title=\"\" href=\"#_ftn18\"><sup><sup>[18]<\/sup><\/sup><\/a><em><\/em><\/p>\n<p style=\"text-align: justify;\"><strong>Obligarea parohiilor de a construi capele \u015fi case unde s\u0103 fie \u0163inu\u0163i mor\u0163ii \u00eenainte de \u00eenmorm\u00e2ntare. <\/strong>Dac\u0103 era posibil, se recomanda a se construi o capel\u0103 special\u0103, unde s\u0103 fie du\u015fi mor\u0163ii, pentru ca trupurile s\u0103 nu fie \u0163inute acas\u0103 la mort, unde pot s\u0103 fie \u00eenc\u0103peri mici \u015fi lumea s\u0103 se \u00eenghesuie, ceea ce ar fi fost o surs\u0103 sigur\u0103 de r\u0103sp\u00e2ndire a microbilor.<em> ,,Drept aceea, \u00eentru urmarea poruncii de la \u00eenaltele locuri purces\u0103 bine \u00eencuvin\u0163\u0103niei voastre \u015fi toatei parohialnicei preo\u0163imi s\u0103 poruncea\u015fte, ca pre norod despre a\u015fa v\u0103t\u0103m\u0103toare obiceaiuri cu cuv\u0103nt \u00een is\u0103ric\u0103 s\u0103 \u00eencuvin\u0163a\u0163(i) \u015fi c\u0103tr\u0103 aceia s\u0103-l sf\u0103tui\u0163i , ca mai cu seam\u0103 ob\u015ftile mai mari \u015fi unde e de lips\u0103 \u015fi putin\u0163\u0103 s\u0103 vede a fi \u00eencet, adic\u0103 cas\u0103 de ob\u015fte pentru mor\u0163i\u00a0 sau la bis\u0103ric\u0103 sau la alt credincios loc c\u0103tr\u0103 mormintele de ob\u015fte s\u0103 se fac\u0103, \u00een carea cas\u0103 trupurile cele moarte p\u0103n\u0103 la \u00eengropare, carea dup\u0103 e\u015firea (celor) 48 de ceasuri are de a fi s\u0103 s\u0103 poat\u0103 a\u015f\u0103za\u201d<\/em><a title=\"\" href=\"#_ftn19\"><sup><sup>[19]<\/sup><\/sup><\/a>.<\/p>\n<p style=\"text-align: justify;\"><strong>Interzicerea de a mai construi morminte \u00een cur\u0163ile bisericilor.<\/strong> \u00cen 1789 se interzice a se\u00a0 s\u0103pa mormintele pe l\u00e2ng\u0103 biserici \u015fi \u00een cur\u0163ile bisericilor.
